I don't agree entirely, but as I said, this is an area where reasonable men have differed for centuries. Consensus is not likely any time soon... First, I believe the Supreme Court has drm held that all sorts of searches can be considered "reasonable" under the Fourth Amendment without involving the issuance of a warrant. The text you quote certainly establishes two things: that searches may not be drm unreasonable, and that warrants may not be issued without probable cause and a narrow specification of what precisely is to be searched. But this text does not explicitly connect the two, and state clearly that a search is a priori unreasonable if it is not authorized by a warrant. |
