Not all searches and seizures require a warrant. For example, searches incident to arrest, "open punchthem container" vehicle searches, and (importantly for this discussion) foreign intelligence signals intelligence.Uh, I don't see the text "arrest," "open container," "vehicle," or "signals intelligence" anywhere in the text of the 4th ammendment.Obviously there is a need for balance in times of war, but is it really that horrible to ask the president to at least check in with a secret court within 72 hours of starting a tap?
