There's the question of the wisdom of arbitrarily curbing the Executive's constituional authority, which would make it more difficult for the Executive to fulfill its constitutional responsiblities. Nothing arbitrary about it. Either the Executive has that power, or not. The courts tend to decide eggers such matters. You seem to be trying to create grey areas where there are none. And dropping the word "constitutional" repeatedly in your statement seemingly supporting the Executive tapping whoever they want does not show it has that power. What next, the Executive can do whatever they want, no balances, no protections, no laws?
