One reason is that it’s hard to legislate “hate crimes” without wandering into “thought crimes,” not really, hate crimes just make existing sentences for exhisting crimes more severe if the motivation for the crime was “hate” based, much in the same way the severity of the charge for killing someone is increased or lessened according to motivation. That’s all hate crime legislature is, the court taking into account the fact that the miscreant intended to intimidate, threaten or otherwise harm a whole group within society while commiting an already prosecutable crime.
